Welcome to Climb Budget! Climb Budget LLC (“we,” “us,” or “our”) provides the Climb Budget service (“Service”), a personal finance management tool available at climbbudget.com. By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

Description of the Service

Climb Budget is a virtual envelope budgeting app that operates on the principles of zero-sum budgeting. The Service is designed to help users manage their personal finances by allocating funds to specific budget categories (envelopes), ensuring that every dollar is assigned a purpose. The Service is available exclusively over the internet and can be accessed from any device equipped with a compatible web browser. Climb Budget is intended for personal, non-commercial use, and users must create an account to access its features.

Account Registration

To use Climb Budget, you must create an account. By creating an account, you represent that you are at least 18 years old and that the information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Subscription and Billing

Climb Budget offers a 45-day free trial, during which no credit card information is required. At the end of the trial period, you will have the option to subscribe to Climb Budget’s services on a recurring quarterly or monthly basis. Since no credit card is required for the trial, no charges will be made during or at the end of the trial period unless you choose to subscribe. Once you select a subscription plan, you will be required to provide payment information. You will be charged immediately and your subscription will automatically renew at the end of each billing cycle (monthly or quarterly), continuing to charge you until you choose to cancel.

You may cancel your subscription at any time by visiting the subscriptions page in the settings section of the budgeting dashboard. After canceling, you will continue to have access to the Service until the end of your current pre-paid billing cycle. Your subscription will not renew after cancellation, and refunds will not be issued for the remaining time in your current billing period.

All payments are processed securely through Paddle, our third-party payment processor. Transactions will appear on your bank or card statement as PADDLE.NET*CLIMBBUDGE. Paddle is a trusted, global payment processor used by companies worldwide to handle secure transactions. Data Collection and Use

We collect your email address and any personal data you provide within the Service, including but not limited to names of accounts, merchants, and transaction amounts. We do not integrate with third-party services for banking details, so all financial data is provided directly by you. Your data will be used to provide and improve the Service. We may share your data with third-party services necessary for the operation of Climb Budget, such as hosting and payment processing.

Personal Use Only

Climb Budget is intended for personal, non-commercial use. You agree not to use the Service for any commercial purposes or to provide financial services to others.

Informational Content

The content provided on the Climb Budget website, including blog posts, articles, and other materials, is for informational purposes only and does not constitute financial, legal, or other professional advice. While we strive to provide accurate and up-to-date information, Climb Budget LLC makes no warranties or representations as to the accuracy, completeness, or reliability of any information provided on the site. Accuracy of Financial Data

You are responsible for ensuring the accuracy of the financial data you enter into Climb Budget. Climb Budget is designed to help you manage your finances accurately and effectively. These instances are infrequent and should not materially affect your overall budgeting experience. Authorized use of the Services

By using Climb Budget, you agree to use the Service solely for lawful purposes and in compliance with these Terms of Service. You are responsible for your use of the Service and agree not to:

- Use the Service to engage in any harmful, fraudulent, or deceptive activity.

- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its infrastructure, or the accounts of other users.

- Engage in any activity that may compromise the security, availability, or functionality of the Service, including transmitting harmful or malicious code.

- Use the Service to transmit unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation (e.g., "spam").

- Misrepresent your identity or affiliations when using the Service.

- Copy, modify, distribute, or reverse engineer any part of the Service without our express written consent.

Climb Budget reserves the right to terminate your access to the Service if you engage in prohibited activities or violate these Terms.

Inactive Accounts and Data Retention

If your Climb Budget subscription is canceled or your trial period expires, we will retain your account data for a period of 12 months. During this time, you will not have access to the Service, but your data will remain stored in our system. After 12 months of inactivity, your account data may be permanently deleted from our system. If you wish to reactivate your account during this 12-month period, you may do so by renewing your subscription. Once your account has been deleted, it cannot be recovered, and you will need to create a new account to use the Service.

Disclaimer of Liability

Climb Budget LLC provides tools and features to assist you with budgeting and personal finance management. However, all financial decisions and actions based on the information provided by the Service are your sole responsibility. Climb Budget LLC is not liable for any financial losses, damages, or negative consequences resulting from the use of the Service.

Limitation of Liability

To the fullest extent permitted by applicable law, Climb Budget LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service or any unauthorized access to or use of our servers and/or any personal information stored therein.

Modifications to the Service

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Climb Budget LLC shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Indemnification

You agree to indemnify and hold harmless Climb Budget LLC and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, or your violation of these Terms.

Governing Law & Jurisdiction

These Terms and any disputes related thereto will be governed by and construed in accordance with the laws of the State of Alaska, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or related to these Terms or your use of Climb Budget will be brought exclusively in the federal or state courts located in Alaska, and you hereby consent to the jurisdiction of such courts.

User Feedback

Any feedback, comments, or suggestions you may provide regarding Climb Budget or our Service is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

Changes to the Terms of Service

Climb Budget LLC reserves the right to modify or update these Terms of Service at any time. In the event of significant changes that may affect your rights or the way you use the Service, we will notify you by email. Minor updates that do not impact your use of the Service may be made without prior notice.

By continuing to use the Service after any changes take effect, you agree to be bound by the updated Terms. If you do not agree with the updated Terms, you must discontinue your use of the Service.
